Mediation is a process of alternative dispute resolution by which the neutral mediator assists the parties in reaching an agreement that they construct. Mediation is not the practice of law. As an attorney-mediator, Ms. Cline has no decision-making authority, but will act as a neutral facilitator to assist the parties in reaching their own agreement. For optimal results, the parties must engage in the mediation process in good faith. The parties must provide full and accurate disclosure of all relevant information and documents, including but not limited to the information that would be produced in the discovery process.
The mediation proceeding is a confidential settlement negotiation and the mediator is required hold all information shared in the mediation process in strictest confidence between each party and the mediator, unless a party gives the mediator permission to disclose the information to the other side. As a result of this confidentiality, parties are free to explore all options for settlement without the concern that an offer may be used against them in litigation.
Upon resolution of some or all of the disputes, the mediator will draft a Memorandum of Understanding which will be signed by all parties and filed with the Court to be adopted as an Order of the Court.
